Your use of the BRBooks.com website ("Site") signifies your agreement with the following terms of Site (the "Terms" or the "TOS"). By using this Site, you agree to follow and be bound by the Terms. BR BOOKS reserves the right, in their sole discretion, to change these Terms at any time by updating this posting. You agree to be bound by the changed Terms through your continued use of this Site.

You understand that the service of BR BOOKS is available for your personal, non-commercial use only. You agree:

Personal Information Collection:

In order to use BR BOOKS, you must submit your email address, address, and phone number. You agree to: provide truthful and accurate information.

Age Requirements:

You must be 13 years of age or older to use the BR BOOKS site. Although BR BOOKS may be accessed by children under the age of 13, we will not knowingly collect or use any personal information from such children. If we become aware that we have collected any personal information from children under 13, we will delete any data collected.

BR BOOKS, in its sole discretion, may refuse service, cancel an order, prohibit your access to BRBooks.com for any and no reason, at any time, and without prior notice or liability

Book Sale Policies:

All sales are final. Once your books are accepted at our warehouse, they cannot be returned to you for any reason. After processing your items, we will send your payment via check (to the address provided in your order) or via PayPal (to the PayPal email address provided in your order).

Order Shipment Policies:

BR BOOKS provides you with a pre-paid USPS mailing label for Media Mail rate of shipment. If you chose to ship your items via another method or mail class, you are responsible for the cost and will NOT be reimbursed by BR BOOKS.

BR BOOKS is not responsible for items that are lost or stolen in shipment. We HIGHLY recommend purchasing USPS Delivery Confirmation Service at the USPS postal counter so that you have proof of delivery to our warehouse. Insurance for your items can also be purchased as the USPS postal counter at your own cost. BR BOOKS is not responsible for items lost or damaged by the USPS.

Sell Back Policies:

You agree to all sell back policies of BR BOOKS. These polices can be found at www.brbooks.com/sellback-policies. These policies include: ISBN Verification Policy, Books NOT Accepted Policy, Book Condition Policy, Packing Slip and Packaging Policy, and Quantity Policy. Any items that do not adhere to our policies will be discarded or recycled. These items will not be returned to the sender. Items damaged in shipment due to poor packaging may be subject to a void of payment or a price adjustment.

Rights of Site Content:

All content on BRBooks.com, including but not limited to designs, text, graphics, artwork, photographs, trademarks, logos, documents, the website as a whole, and their selection, are the proprietary property of the BR BOOKS and are protected under U.S. and international law and treaties. All rights are reserved. The site’s content may not be used, modified, copied, distributed, reproduced, republished, downloaded, transmitted, or sold in any form or by any means, in whole or in part, without the written permission of BR BOOKS. You may not republish the site’s contents on any other website.

  2.   5. A SMALL PERCENTAGE OF USERS MAY EXPERIENCE EPILEPTIC SEIZURES WHEN EXPOSED TO CERTAIN LIGHT PATTERNS OR BACKGROUNDS ON A COMPUTER SCREEN OR WHILE USING THE SITE. CERTAIN CONDITIONS MAY INDUCE PREVIOUSLY UNDETECTED EPILEPTIC SYMPTOMS EVEN IN USERS WHO HAVE NO HISTORY OF PRIOR SEIZURES OR EPILEPSY. IF YOU, OR ANYONE IN YOUR FAMILY, HAVE AN EPILEPTIC CONDITION, CONSULT YOUR PHYSICIAN PRIOR TO USING THE SITE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 17 AND 18 MAY NOT APPLY TO YOU.

NO THIRD-PARTY BENEFICIARIES

You agree that, except as otherwise expressly provided in this TOS, there shall be no third-party beneficiaries to this agreement.

NOTICE

BR BOOKS may provide you with notices, including those regarding changes to the TOS, by email, regular mail or postings on the Site.

GENERAL INFORMATION

Entire Agreement. The TOS constitutes the entire agreement between you and BR BOOKS and governs your use of the Site, superseding any prior agreements between you and BR BOOKS with respect to the Site. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other BR BOOKS sites, affiliate sites, third-party content or third-party software.

Choice of Law and Forum. The TOS and the relationship between you and BR BOOKS shall be governed by the laws of the State of New Jersey without regard to its conflict of law provisions. You and BR BOOKS agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Bergen, New Jersey.

Waiver and Severability of Terms. The failure of BR BOOKS to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.

Statute of Limitations. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

The section titles in the TOS are for convenience only and have no legal or contractual effect.
